Course overview

Malpractice cases related to traumatic brain injury (TBI) are focused on a wide range of issues. Head injury malpractice complaints most commonly allege: the failure to diagnose the injury through an inadequate physical examination or diagnostic evaluation; missed head injury in children or the failure to diagnose TBI in the elderly; the failure to provide adequate head injury discharge instructions; the failure to adequately manage the alcohol-impaired patient; and making the correct diagnosis, but failure to adequately treat through aggressive management, consultation or transfer. In general, these cases involve dramatic injury with severe permanent disability and/or death. Thus, settlements and verdicts are quite large.
