To have DHCP understand that HIPAA compliance cannot be totally delegated to an outside consultant, without having the DHCP first understand the scope of the requirements.
Additionally, have DHCP understand that compliance with the HIPAA Omnibus Final Rule, goes beyond having patients sign a couple of forms, it involves a multidisciplinary practice management approach, and a concerted effort that requires organizational commitment and intent, stemming from the DHCP, Administrators, Managers, IT Consultants, Business Associates and Staff.
This approach begins by having the DHCP understand:
- the difference between the Privacy Rule and the Omnibus Final Rule;
- the specific guidelines under the Omnibus Final Rule;
- the CE’s responsibilities;
- the financial penalties for none compliance, and the meaning of the term “Willful Neglect” under the Rule;
- what is consider a Breach under the Omnibus Final Rule;
- the Breach Notification Policy;
- and most importantly, DHCP must understand that these rules are “Federal Mandates” with very powerful enforcement directives to HHS and the OCR, which are the enforcing organizations;
Therefore, DHCP should have a responsive Compliance Implementation Plan, and become aware over the potential liabilities for non-compliance. HIPAA is not a female HIPPO, it is a serious Federal Mandate carrying stiff penalties.

Course overview
This course encompasses the Omnibus Final Rule's most important general requirements from DHCP and CE. It does not impart Administrative Policies and Procedures since this requirement must be complied and addressed by each individual dental practice or CE. Therefore, it is recommended that additional Staff Training be conducted after the Administrative Policies and Procedures are implemented in order for staff to comply with the CE's specific Policies and Procedures as required by the Omnibus Final Rule. The primary goal of the course is to make DHCP understand that the HIPAA's Privacy Act and the HITECH Act or Omnibus Final Rule main's goal is not only to protect patients PHI, but grant ownership rights to patients of their PHI. Additionally, to protect the electronic transmission of their PHI, and limit access to patient's PHI by determining who "Needs to Know" the PHI, in order to provide healthcare to patients, which may include limiting those "workforce member" who do not need to access the patients' PHI to conduct their work, and/or excluding complete access to patients' PHI.
